Note to Purchaser: Angel Armor reserves the right in its sole and absolute discretion to modify or replace all or any portion of these warranty terms with respect to subsequent transactions with purchaser.
1.Applicable NIJ Standard. The ballistic insert portion of each Angel Armor, Inc. (“Angel Armor”) product(s) listed above (each, a “Product”) has been tested at a laboratory accredited by the National Institute of Justice (“NIJ”) and independently verified to meet or exceed the minimum ballistic resistance performance specified under the following NIJ Standard (the “Standard”): Ballistic Resistant Protective Materials – NIJ STD-0101.06, against the threat level designated on the product’s label. Angel Armor’s statement that the Product meets or exceeds the Standard is valid only for new and unused product as of the time of sale, and is subject to all of the limitations and qualifications set out below. The purchaser in every case should confirm that the Product (i) has been tested against a NIJ standard that, if met, would be capable of stopping the ammunition used by the weapons suitable to the purchaser; and (ii) meets every applicable standard required by the agency in which the purchaser serves.
2. Scope and Duration of Our Express Limited Warranty; Sole and Exclusive Remedy.
a. Subject to all of the terms and conditions of this document, Angel Armor warrants to purchaser only that: (1) the ballistic insert portion of the Product has been tested against the Standard described in Section 1 above; and (2) that for a period of (i) sixty (60) months after the date of sale to the original purchaser with respect to the ballistic insert portion of the Product, and (ii) twenty-four (24) months after the date of sale to the original purchaser with respect to the carrier portion of the Product, such portion of the Product shall be free from defects in material and workmanship. The sole and exclusive means for determining whether the foregoing expressly limited warranty has been met will be the performance of the examination and optional testing protocols described in Section 2.b. below. Where the date of sale cannot be clearly established and/or documented, Angel Armor’s warranty period shall be held to commence on the date of commencement of manufacture of the lot from which the relevant Product unit was made. The Product must be used and maintained in strict accordance with the instructions set out in this document and in our Product specifications, and compliance with all of the foregoing is a condition precedent to any warranty claim. IN NO EVENT SHOULD OUR PRODUCTS BE RELIED UPON AFTER THE EXPIRATION OF THE (AS THE CASE MAY BE) TWENTY-FOUR (24) OR SIXTY (60) MONTH WARRANTY TERM.
b. In the event that the purchaser returns a Product unit based on a claim that the Product has not complied with our express limited warranty in this document, Angel Armor will use reasonable commercial efforts to examine the returned unit (if made available by the purchaser); and to verify and determine the cause of the alleged breach of the warranty (e.g., by examining whether multiple units of Product that were manufactured from the same lot of ballistic or material have been returned). Angel Armor may, at its discretion, conduct additional testing of the returned unit or other units of Product from the same lot (if either is available). Notwithstanding any contrary provision or representation, whether the Product unit in question complied with the Standard shall be determined exclusively by Angel Armor based on its internal examination and, if conducted, the testing described above. Any ballistic performance or other tests performed by the purchaser or any other third party shall not be valid in any manner whatsoever for purposes of warranty claims. For the avoidance of doubt, the Product warranty is limited to only those threats specifically identified in the Standard designated above, and does not extend to any special or other threats not specifically identified in the Standard. If Angel Armor in its sole and absolute discretion determines that a product does not conform to the express limited warranty in Section 2.a., Angel Armor shall at its election replace, repair, or issue a pro-rated purchase price credit for such Product unit. Such repair, replacement or refund shall be Angel Armor’s sole obligation and purchaser’s sole remedy with respect to a breach of warranty claim. A Return Materials Authorization (“RMA”) number must be obtained from Angel Armor prior to returning any Product. RMA number requests and all other warranty-related correspondence should be directed to service@angelarmor.com. All returns shall be made to Angel Armor’s manufacturing facility indicated in the RMA and must include: (1) proof of date of purchase; and (2) documentation (including, where available, images of the damage) specifying the claimed defect and all relevant supporting information. Purchaser should inspect and try on the Product promptly after receipt. Do not wear the Product if it does not fit properly, or if it ceases to fit properly subsequent to purchase due to changes in your body type or otherwise. An RMA number must be obtained from Angel Armor prior to returning any Product for any reason, including, but not limited, to, incorrect fit. RMA number requests should be directed to service@angelarmor.com.
3. Disclaimer of Any Other Express Warranties and Implied Warranties; Limitation of Liability
a. Warranty Disclaimer. The express limited warranty in Section 2.a. above is the sole and exclusive warranty made by Angel Armor, to the original purchaser only, with respect to the Product. Other than through an express written agreement signed by an authorized Angel Armor officer and our original purchaser, our warranties may not be altered. Without limiting the generality of the foregoing, our warranties may not be and are not expanded or altered by any terms or conditions on a Purchase Order; by any representations, descriptions, course of dealing, trade usage, technical advice, service, samples, models, or marketing materials; or by any acts, statements, or agreements done or purported to be made by any third party (e.g., by any distributor, dealer, or agent of Angel Armor). ANGEL ARMOR MAKES NO OTHER WARRANTIES – EXPRESS, IMPLIED, OR STATUTORY – INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE OR MERCHANTABILITY, OR NON-INFRINGEMENT.
b. LIMITATIONS OF LIABILITY. IN NO EVENT SHALL ANGEL ARMOR (OR ANY OF OUR OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS) BE LIABLE FOR ANY OF: (I) THE COST OF REPLACEMENT PRODUCTS; (II) ANY PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, ANTICIPATED OR LOST PROFITS, INCIDENTAL DAMAGES, LOSS OF TIME, OR OTHER INDIRECT LOSSES OR EXPENSES THAT ARISE FROM ANY CAUSE RELATING TO OUR PRODUCT, REGARDLESS OF THE FORM OF THE ACTION, WHETHER IN TORT (INCLUDING NEGLIGENCE), CONTRACT, STRICT LIABILITY OR OTHERWISE, AND REGARDLESS OF WHETHER ANGEL ARMOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; OR (III) DIRECT DAMAGES EXCEEDING THE PURCHASE PRICE ACTUALLY PAID FOR THE PRODUCT UNIT(S) GIVING RISE TO SUCH PURPORTED LIABILITY.
c. Compliance with Law. Certain jurisdictions do not permit certain limitations on warranties or remedies. In the event the laws of any jurisdiction apply to a transaction covering our products, the foregoing limitations in Sections 3.a. and 3.b. may be amended insofar, and only insofar, as required by such laws.
4. Conditions Precedent to and Limits on Warranty Coverage
a. Carrier Design and Dimensions; Repairs; Storage; Cleaning.
Carrier Design and Dimensions. The Product is designed to be used by inserting and keeping the ballistics insert in the proper pocket of the carrier, with the pocket closed. This described use (ballistic insert in the closed carrier pocket) is the basis for the Product’s NIJ-tested level of protection stated above. Please note that the Product carrier also may contain a separate and additional pocket that is designed to contain an Angel Armor-manufactured trauma plate (and that is not designed to hold the ballistics insert). Any such trauma plate must be purchased, separately, from Angel Armor or its distributors and is subject to its own separate warranty (and is not covered by this warranty). The proper use of such a trauma plate may provide additional ballistic protection, but does not enhance the protection rating (e.g., the NIJ rating) of the Product. The Product is designed to provide protection only if the ballistic insert (and if purchased separately, the trauma plate) is secured, alone, into the appropriate closed pocket of the vest covering the cavity of a person who is wearing the appropriately sized vest, and only for so long as the ballistic insert (or trauma plate) remains in that protective position. Do not insert the ballistics insert into the pocket designed for the trauma plate (or vice versa). Angel Armor is not responsible, as examples, for injuries that result from insertion of the ballistics insert into the incorrect pocket, or from failure to close the pocket.
Repairs. Any damage to the Product (ballistic insert or carrier) should be corrected by Angel Armor or by its authorized repair partners. Purchaser should not attempt to repair the Product or any portion of it.
Storage. Angel Armor recommends storing the Product at room temperature in a dry location and never in high temperature storage locations that may exceed 150 degrees Fahrenheit (e.g., in a vehicle trunk). The Product should be stored on a flat surface or, if no such surface is available, on a hanger. The Product should never be stored in a manner in which the Product is folded, compressed or creased.
Cleaning. Clean each component of your RISE Armor System separately and NEVER as a complete system.
CLEANING RISE ARMOR PANELS
Remove the front and rear armor panels from carrier before cleaning. Gently wipe with a damp sponge or cloth using cold water and a mild laundry detergent if necessary. Lay flat and wipe dry. The shoulder straps and belt may be cleaned in a similar manner.
Do not immerse in liquid. Do not machine wash. Do not use bleach. Do not dry clean. Do not tumble dry. Do not expose to extreme heat.
CLEANING RISE ARMOR CARRIERS
DO NOT machine wash. Remove the armor panels and/or hard armor plates from the carrier before cleaning. Surface wipe carrier for normal dirt & dust using a soft, clean sponge or cloth using cold water and a mild laundry detergent if necessary. To treat tough spots on the carrier’s exterior fabric, pretreat by spraying a laundry-stain remover or dry-cleaning solvent. Allow to soak into fabric for a least an hour. Combine 8 oz. of warm water with 1 tbsp. of a bleach-free and chlorine-free laundry detergent in a spray bottle. Swirl the bottle to mix. Spray the cleaning solution onto the stain. Use a soft to medium bristled cleaning brush to work the cleaning solution into the fabric. Dampen a soft cloth with cool water and squeeze to remove excess moisture. Wipe down to remove any soap residue. Place carrier on a hanger and allow to air dry indoors. Ensure the carrier is completely dry before reinserting armor panels.
Do not machine wash. Do not bleach. Do not use citrus based cleaners. Do not dry clean. Do not tumble dry. Do not iron. Do not wash with hot water.
In addition to voiding the warranty, any of the foregoing actions or events could cause the Product unit to fail and could expose the user to increased risk of serious injury or death.
b. Modification and Misuse.Angel Armor has delivered the Product ready for use in accordance with its specifications and related documentation. Our express limited warranty above applies only to our Products as originally manufactured by or for Angel Armor, and only if used properly. Our warranty shall be void as to Product units that have been changed, modified, or altered in any way by any person or entity other than Angel Armor. Our warranty also shall be void as to any Product unit that has been subjected to misuse, abuse, accident, neglect, breakage, alteration, damage, improper storage or handling, theft, or any repair or service not performed by Angel Armor.
For the avoidance of doubt, “misuse” for this purpose includes but is not limited to any of the actions in 4.a. above, and any one or more of the following:
(i) cutting, piercing, or attempting to shape any portion of the Product unit;
(ii) applying glues, solvents, or other chemicals (e.g., petroleum or chlorine) to the Product unit;
(iii) exposing the Product unit to extremes of temperatures (exceeding 150 degrees Fahrenheit) or other extreme environmental conditions (whether in use or in storage);
(iv) attempting to install the ballistics portion of the Product unit in a vest other than that with which it was delivered in accordance with Angel Armor’s recommendations;
(v) storing or cleaning either the ballistics portion or the vest portion of the Product in violation of the procedures described below; or
(vi) taking any other action that would expose or damage the ballistic resistance technologies incorporated within the Product.
c. Specific Product Usage Limitations and Product Warnings
FAILURE TO CLOSELY FOLLOW ALL WARNINGS AND INSTRUCTIONS WILL VOID ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO ANY BALLISTIC PERFORMANCE WARRANTY, AND COULD LEAD TO SERIOUS INJURY OR DEATH.
Without limiting the effect of Sections 4.a. or 4.b. above, or of the prior sentence, the following instructions and warnings are a non-exclusive list of instructions and warnings that are important to the proper use of the Products. The warnings below further define and limit the scope of Angel Armor’s limited express warranty. Failure to follow the instructions below will void our warranty obligations.
i. Any combat situation or other hostile environment is inherently hazardous. The Product will not provide protection from all threats potentially faced. The Product is a last resort measure to reduce risk after all other actions and methods to preserve personal safety have failed. While some models of the Product may provide limited protection against fragmentation and without limiting the generality of the preceding sentences, the Product is not designed to protect against bursting munition threats such as IED’s, mines, hand grenades, mortar fire and/or rifle fire, sharp-edged or pointed objects. Also, should the Product be struck by a projectile close to the panel’s edge, the Product’s ability to dissipate the projectile’s energy may be adversely impacted.
ii. Do not remove or obscure the affixed Product label. It provides important information specific to the Product including the Standard and the types of threats against which the Product has been tested, as described above. Your removal or obscuring of the Product label or messaging will void our warranty, and also could cause increased risk of serious injury or death.
iii. Purchase this Product only if it is appropriate to your threat risk. It is your obligation to determine in advance if the Product is designed and tested against these types of threats. Without limiting the generality of the foregoing sentence, the Products are designed to lessen the risk of injury or death from those threats indicated on the affixed Product messaging and as described in the Standard. User should read and fully understand that Standard’s various threat levels, and the limitations on the protection afforded by each.
iv. Even for those threats included within the Product’s specified NIJ threat level, the Product is only ballistic resistant, NOT “bullet proof”. Even where a Product has stopped a threat, some degree of injury to the user could occur, and death is still possible. Ballistics are highly unpredictable and projectiles of any sort can ricochet or deflect off of the Product, and/or shatter into fragments that can pass through the Product, in either case possibly resulting in injury or death.
v. The greater the amount of impacts and the closer the proximity of each impact, the greater the possibility a projectile may penetrate the Product, resulting in serious injury or death. For convenience to the user, the front panel of the Product is equipped for PALS-compatible accessories. Angel Armor is not responsible for any injury caused by ricochet, shrapnel or other damage caused by impact to an accessory worn on the Product.
vii. Purchaser or its agents must carefully inspect each Product unit before using it. Should the ballistics insert portion of the Product unit be broken, interrupted, cracked or damaged in any way, it should immediately be sent to Angel Armor or its authorized dealer for an inspection using the RMA process described above. Do not use any ballistics insert portion of the Product unit if it is chipped, cracked, delaminated or separated, or shows any other physical change or deterioration. Any of the foregoing may either cause the product to be ineffective or indicate that it has become ineffective, exposing the user to increased risk of serious injury or death. Should the vest portion of the Product be excessively worn, being mildewed or rotted, purchaser should cease using the vest.
Note to Purchaser: Angel Armor reserves the right in its sole and absolute discretion to modify or replace all or any portion of these warranty terms with respect to subsequent transactions with purchaser.
a. Subject to all of the terms and conditions of this document, Angel Armor warrants to purchaser only that: (1) the Product has been tested against the Standard described in Section 1 above; and (2) that for a period of sixty (60) months after the date of sale to the end user, the Product shall be free from defects in material and workmanship. IN NO EVENT SHOULD OUR PRODUCTS BE RELIED UPON AFTER THE EXPIRATION OF THE SIXTY (60) MONTH WARRANTY TERM.
b. In the event that the purchaser returns a Product unit based on a claim that the Product has not complied with our express limited warranty in this document, Angel Armor will use reasonable commercial efforts to examine the returned unit (if made available by the purchaser); and to verify and determine the cause of the alleged breach of the warranty (e.g., by examining whether multiple units of Product that were manufactured from the same lot of ballistic material have been returned). All returns shall be made to Angel Armor’s manufacturing facility indicated in the RMA and must include: (1) proof of date of purchase; and (2) documentation (including, where available, images of the damage) specifying the claimed defect and all relevant supporting information.
In the event the laws of any jurisdiction apply to a transaction covering our products, the foregoing limitations in Sections 3.a. and 3.b. may be amended insofar, and only insofar, as required by such laws.
a. Product Design and Dimensions; Use in Conjunction with Vest. The Product is designed to allow for its insertion into the vest’s specific design solution for containing a trauma plate of the appropriate size, per the vest manufacturer’s instructions. The trauma plate is to be installed over ballistic protection only, and is intended for use with NIJ certified ballistic protective vests (vest). The Product is designed to provide protection only if it is secured into a pocket or slot covering the cavity of a person who is wearing the appropriate vest, and only for so long as the Product remains in that protective position. Our Product warranty applies only to our Product, and not to any vest into which our Product is inserted, or to any combination of our Product with the vest. The use of our Product does not enhance the protection rating (e.g., the NIJ rating) of any vest. Moreover, each vest may have a different method of restraining or holding trauma plates similar to our Products in the proper protective position. Angel Armor is not responsible for any risk or injury resulting from the selected vest or its properties. Angel Armor is not responsible, as examples, for injuries that result from: failure of the pocket or slot closure (e.g., Velcro or button) to hold the Product in place; movement of the Product within a vest pocket or slot, out of position; or tears in or other failures of the vest material. Nor are we responsible if, as a result of weight or body type of the user, the Product remains controlled within the vest but nevertheless does not sit flush over the vest’s intended protection area. Angel Armor is not responsible for damage or injuries resulting from any alteration or customization of a vest or other product.
b. Modification and Misuse. Angel Armor has delivered the Product units ready for installation and use in accordance with its specifications and related documentation. Our express limited warranty above applies only to our Products as originally manufactured by or for Angel Armor. Our warranty shall be void as to Product units that have been changed, modified, or altered in any way by any person or entity other than Angel Armor. Our warranty also shall be void as to any Product unit that has been subjected to misuse, abuse, accident, neglect, breakage, alteration, damage, improper storage, been dropped, or handling, theft, or any repair or service not performed by Angel Armor. For the avoidance of doubt, “misuse” for this purpose includes but is not limited to any one or more of the following: cutting, piercing, or attempting to shape all or any portion (e.g., the outer layer) of the Product unit; applying glues, solvents, or other chemicals to the Product unit; exposing the Product unit to extremes of temperature, humidity (including rain or excessive sweat), or other environmental conditions (whether in use or in storage), attempting to install the Product unit in a vest other than in accordance with Angel Armor’s recommendations; or taking any other action that would expose or damage the ballistic resistance technologies incorporated within the Product. The Product is specifically not designed to be washed or cleaned with any vest and should be removed from the vest before the vest is cleaned. In addition to voiding out the warranty, any of the foregoing actions or events could cause the Product unit to fail and could expose the user to increased risk of serious injury or death.
Failure to follow the instructions below will void our warranty obligations.
i.Any combat situation or other hostile environment is inherently hazardous. The Product will not provide protection from all threats potentially faced. The Product is a last resort measure to reduce risk after all other actions and methods to preserve personal safety have failed. Without limiting the generality of the foregoing, the Product is not designed to protect against bursting munition threats such as IED’s, mines, hand grenades, and/or mortar fire. Also, should the Product be struck by a projectile close to the panel’s edge, the Product’s ability to protect the user may be adversely impacted.
ii.Do not remove or obscure the affixed Product label. It provides important information specific to the Product including the Standard and the types of threats against which the Product has been tested, as described above. Your removal or obscuring of the Product label or messaging will void our warranty, and also could cause increased risk of serious injury or death.
iii.Purchase this Product only if it is appropriate to your threat risk. It is yourobligation to determine in advance if the Product is designed and tested against these types of threats. Without limiting the generality of the foregoing sentence, the Products are designed to lessen the risk of injury or death from those threats indicated on the affixed Product messaging and as described in the Standard. User should read and fully understand such Standard’s various threat levels, and the limitations on the protection afforded by each.
iv. Even for those threats included within the Product’s relevant specified NIJ threat level, the Product is only ballistic resistant and stab resistant, NOT “bullet proof”. Even where a Product has stopped a threat, some degree of injury to the user could occur, and death is still possible. Ballistics are highly unpredictable and projectiles of any sort can ricochet or deflect off of the Product, and/or shatter into fragments that can pass through the Product, in either case possibly resulting in injury or death.
v.The greater the amount of impacts and the closer the proximity of each impact, the greater the possibility a projectile may penetrate the Product, resulting in serious injury or death.
vi.Purchaser or its agents must carefully inspect each Product unit before using it in conjunction with the appropriate vest. Should the Product unit be broken, interrupted, cracked or damaged in any way, Purchaser should promptly contact Angel Armor or its authorized dealer to determine whether an inspection using the RMA process described above is necessary. Do not use any Product unit if it is chipped, cracked, delaminated or separated, or shows any other physical change or deterioration, unless it has been approved by Angel Armor or its authorized dealer. Any of the foregoing may either cause the product to be ineffective or indicate that it has become ineffective, exposing the user to increased risk of serious injury or death.
Note to Purchaser: Angel Armor reserves the right in its sole and absolute discretion to modify or replace all or any portion of these warranty terms with respect to subsequent transactions with purchaser.
1. Applicable NIJ Standard. The Angel Armor, Inc. (“Angel Armor”) product listed above (the “Product”) has been tested at a laboratory accredited by the National Institute of Justice (“NIJ”) and independently verified to meet or exceed the minimum ballistic resistance performance specified under the following NIJ Standard (the “Standard”): Ballistic Resistant Protective Materials – NIJ STD-0108.01, against the threat level designated on the product’s label. Angel Armor’s statement that the Product meets or exceeds the Standard is valid only for new and unused product as of the time of sale, and is subject to all of the limitations and qualifications set out below.
2. Scope and Duration of Our Express Limited Warranty; Sole and Exclusive Remedy.
3. Disclaimer of Any Other Express Warranties and Implied Warranties; Limitation of Liability
a. Warranty Disclaimer. The express limited warranty in Section 2.a. above is the sole and exclusive warranty made by Angel Armor with respect to the Product.
4. Conditions Precedent to and Limits on Warranty Coverage
a. Product Design and Dimensions. The Product is designed to allow for its insertion into certain areas of certain vehicle types specified in our individual Product specifications. This design requires the Product to incorporate holes, gaps, and other similar features to enable the vehicle part (e.g., the door) to function, and to allow insertion into the vehicle by the purchaser or the purchaser’s agents (e.g., upfitter, installer, mechanic). Angel Armor’s warranty does not apply to any such holes, gaps or similar Product design features, which areas may provide a lower level of protection than other parts of the Product, or no protection at all. Angel Armor also notifies purchaser that the design of the Product may allow it to be subject to risk of removal and theft, even if the vehicle is otherwise locked.
b. Modification and Misuse. Angel Armor has delivered the Product units ready for installation and use in accordance with its specifications and related installation instructions. Our express limited warranty above applies only to our Products as originally manufactured by or for Angel Armor. Our warranty shall be void as to Product units that have been changed, modified, or altered in any way by any person or entity other than Angel Armor. Our warranty also shall be void as to any Product unit that has been subjected to misuse, abuse, accident, neglect, breakage, alteration, damage, improper storage or handling, theft (whether installed in a vehicle or not), or any repair or service not performed by Angel Armor. For the avoidance of doubt, “misuse” for this purpose includes but is not limited to any one or more of the following: cutting, piercing, or attempting to shape all or any portion (e.g., the outer layer) of the Product unit; applying glues, solvents, or other chemicals to the Product unit; exposing the Product unit to extremes of temperature, humidity, or other environmental conditions (whether in use or in storage) attempting to install the Product unit other than in accordance with Angel Armor’s installation instructions; or taking any other action that would expose or damage the ballistic resistance technologies incorporated within the Product unit. In addition, “misuse” also covers damage to the Product unit resulting from the operation of the vehicle into which the Product is inserted, including as non-exclusive examples car accidents, electrical short circuits, and manufacturing defects or part failures within the vehicle. In addition to voiding out the warranty, any of the foregoing actions or events could cause the Product unit to fail and could expose the user to increased risk of serious injury or death.
Without limiting the generality of the foregoing, the Product is not designed to protect against bursting munition threats such as IED’s, mines, hand grenades, mortar fire and/or rifle fire, sharp-edged or pointed objects.
Ballistics are highly unpredictable and projectiles of any sort can ricochet or deflect off of the Product, and/or shatter into fragments that can pass through the Product, in either case possibly resulting in injury or death.
v. The greater the amount of impacts and the closer the proximity of each impact, the greater the possibility a projectile may penetrate the Product, resulting in serious injury or death.
vi. Purchaser or its agents must carefully inspect each Product unit before using or installing it. Should the Product unit be broken, interrupted, cracked or damaged in any way, it should immediately be sent to Angel Armor or its authorized dealer for an inspection using the RMA process described above. Do not use any Product unit if it is chipped, cracked, delaminated or separated, or shows any other physical change or deterioration.
The Angel Armor, LLC (“Angel Armor”) product listed above (the “Product”) has been tested at a laboratory accredited by the National Institute of Justice (“NIJ”) and independently verified to meet or exceed the minimum ballistic resistance performance specified under the following NIJ Standard (the “Standard”): Ballistic Resistant Protective Materials – NIJ STD-0108.01, against the threat level designated on the product’s label. Angel Armor’s statement that the Product meets or exceeds the Standard is valid only for new and unused product as of the time of sale, and is subject to all of the limitations and qualifications set out below.
2. Scope and Duration of Our Express Limited Warranty; Sole and Exclusive Remedy.
a. Subject to all of the terms and conditions of this document, Angel Armor warrants to purchaser only that: (1) the Product has been tested against the Standard described in Section 1 above; and (2) that for a period of sixty (60) months after the date of sale to the original purchaser, the Product shall be free from defects in material and workmanship.
RMA number requests and all other warranty-related correspondence should be directed to service@angelintelligence.com. All returns shall be made to Angel Armor’s manufacturing facility indicated in the RMA and must include: (1) proof of date of purchase; and (2) documentation (including, where available, images of the damage) specifying the claimed defect and all relevant supporting information.
3. Disclaimer of Any Other Express Warranties and Implied Warranties; Limitation of Liability
a. Warranty Disclaimer. The express limited warranty in Section 2.a. above is the sole and exclusive warranty made by Angel Armor with respect to the Product.
IN NO EVENT SHALL ANGEL ARMOR (OR ANY OF OUR MEMBERS, MANAGERS, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS) BE LIABLE FOR ANY OF: (I) THE COST OF REPLACEMENT PRODUCTS; (II) ANY PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, ANTICIPATED OR LOST PROFITS, INCIDENTAL DAMAGES, LOSS OF TIME, OR OTHER INDIRECT LOSSES OR EXPENSES THAT ARISE FROM ANY CAUSE RELATING TO OUR PRODUCT, REGARDLESS OF THE FORM OF THE ACTION, WHETHER IN TORT (INCLUDING NEGLIGENCE), CONTRACT, STRICT LIABILITY OR OTHERWISE, AND REGARDLESS OF WHETHER ANGEL ARMOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; OR (III) DIRECT DAMAGES EXCEEDING THE PURCHASE PRICE ACTUALLY PAID FOR THE PRODUCT UNIT(S) GIVING RISE TO SUCH PURPORTED LIABILITY.
4. Conditions Precedent to and Limits on Warranty Coverage
Angel Armor also notifies purchaser that the design of the Product may allow it to be subject to risk of removal and theft, even if the vehicle is otherwise locked, and that installation of this Product may affect how vehicle panel performs from day to day or in the event of an accident due to increased weight and differences in material composition.
b. Modification and Misuse. Angel Armor has delivered the Product units ready for installation and use in accordance with its specifications and related installation instructions. Failure to abide by the installation instructions may not only void the express limited warranty, but may also impact performance of the Product, as well as the vehicle into which it has been installed. Angel Armor shall not be held liable for any damage caused by an improper installation of the Product. Our express limited warranty above applies only to our Products as originally manufactured by or for Angel Armor. Our warranty shall be void as to Product units that have been changed, modified, or altered in any way by any person or entity other than Angel Armor. Our warranty also shall be void as to any Product unit that has been subjected to misuse, abuse, accident, neglect, breakage, alteration, damage, improper storage or handling, theft, or any repair or service not performed by Angel Armor. In addition to voiding out the warranty, any of the foregoing actions or events could cause the Product unit to fail and could expose the user to increased risk of serious injury or death.
Note to Purchaser: Angel Armor reserves the right in its sole and absolute discretion to modify or replace all or any portion of these warranty terms with respect to subsequent transactions with purchaser.
1. Applicable NIJ Standard. The Angel Armor, LLC (“Angel Armor”) product(s) listed above (the “Product”) has been tested at a laboratory accredited by the National Institute of Justice (“NIJ”) and independently verified to meet or exceed the minimum ballistic resistance performance specified under the following NIJ Standard (the “Standard”): Ballistic Resistant Protective Materials – NIJ STD-0108.01, against the threat level designated on the Product’s Care and Maintenance insert. Angel Armor’s statement that the Product meets or exceeds the Standard is valid only for new and unused product as of the time of sale, and is subject to all of the limitations and qualifications set out below. The Standard is applicable to all ballistic resistant materials intended to provide protection against gunfire, with the exception of body armor and ballistic helmets, which are the topic of separate NIJ performance standards.
2. Disclaimer of Any Other Express Warranties and Implied Warranties; Limitation of Liability
a. Warranty Disclaimer. Subject to all of the terms and condition of this document, Angel Armor warrants to purchaser only that the Product has been tested against the Standard described is Section 1 above. This is the sole and exclusive warranty made by Angel Armor with respect to the Product. Other than through an express written agreement signed by an authorized Angel Armor officer and our original purchaser, our warranty may not be altered. Without limiting the generality of the foregoing, our warranty may not be and are not expanded or altered by any terms or conditions on a Purchase Order; by any representations, descriptions, course of dealing, trade usage, technical advice, service, samples, models or marketing materials; or by any acts, statements or agreements done or purported to be made by any third party (e.g., by any distributor, dealer, or agent of Angel Armor). ANGEL ARMOR MAKES NO OTHER WARRANTIES – EXPRESS, IMPLIED, OR STATUTORY – INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, OR NON-INFRINGEMENT.
b. LIMITATIONS OF LIABILITY. IN NO EVENT SHALL ANGEL ARMOR (OR ANY OF OUR MEMBERS, MANAGERS, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS) BE LIABLE FOR ANY OF: (I) THE COST OF REPLACEMENT PRODUCTS; (II) ANY PUNITIVE, EXEMPLARY OR CONSEQUENTIAL DAMAGES, ANTICIPATED OR LOST PROFITS, INCIDENTAL DAMAGES, LOSS OF TIME OR OTHER INDIRECT LOSSES OR EXPENSES THAT ARISE FROM ANY CAUSE RELATING TO OUR PRODUCT, REGARDLESS OF THE FORM OF THE ACTION, WHETHER IN TORT (INCLUDING NEGLIGENCE), CONTRACT, STRICT LIABILITY OR OTHERWISE, AND REGARDLESS OF WHETHER ANGEL ARMOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; OR (III) DIRECT DAMAGES EXCEEDING THE PURCHASE PRICE ACTUALLY PAID FOR THE PRODUCT UNIT(S) GIVING RISE TO SUCH PURPORTED LIABILITY.
c. Compliance with Law. Certain jurisdictions do not permit certain limitations on warranties or remedies. In the event the laws of any jurisdiction apply to a transaction covering our products, the foregoing limitations in Sections 2.a. and 2.b. may be amended insofar, and only insofar, as required by such laws.
3. Product Usage Limitations and Warnings; Disclaimer
a. Modification and Misuse. Angel Armor has delivered the Product units ready for use in accordance with its specifications and related Care and Maintenance instructions. Angel Armor expressly disclaims any and all liability associated with any Products that have been changed, modified or altered in any way by any person or entity other than Angel Armor. Angel Armor also disclaims any and all liability associated with any Product unit that has been subjected to misuse, abuse, accident, neglect, breakage, alteration, damage, improper storage or handling theft or any repair or service not performed by Angel Armor. For the avoidance of doubt, “misuse” for this purpose includes but is not limited to any one or more of the following: cutting, piercing or attempting to shape all or any portion (e.g., the outer layer) of the Product unit; applying glues, solvents or other chemicals to the Product unit; exposing the Product unit to extremes of temperature, humidity (including rain or excessive sweat) or other environmental conditions (whether in use or in storage); or taking any other action that would expose or damage the ballistic resistant technologies incorporated within the Product unit. The Product is specifically not designed to be washed or cleaned with any garment or other textile product and should be removed from any garment or other textile product before it is cleaned. In addition to voiding out any warranty, any of the foregoing actions or events could cause the Product unit to fail and could expose the user to increased risk of serious injury or death.
b. Specific Product Usage Limitations and Product Warnings
FAILURE TO CLOSELY FOLLOW ALL WARNINGS AND INSTRUCTIONS COULD LEAD TO SERIOUS INJURY OR DEATH.
Without limiting the effect of Sections 3.a. above, or of the prior sentence, the following instructions and warnings are a non-exclusive list of instructions and warnings that are important to the proper use of the Products. Angel Armor expressly disclaims any and all liability resulting from failure to follow the instructions below or those included with the Product.
i. Any combat situation or other hostile environment is inherently hazardous. Use of this Product is not a substitute for safe behavior. The Product will not provide protection from all threats potentially faced. The Product is a last resort measure to reduce risk after all other actions and methods to preserve personal safety have failed. Without limiting the generality of the foregoing, the Product is not designed to protect against bursting munition threats such as IED’s, mines, hand grenades, mortar fire and/or rifle fire, sharp-edged or pointed objects. Also, should the Product be struck by a projectile within two (2) inches of the ballistic package edge, the Product’s ability to dissipate the projectile’s energy may be adversely impacted. In addition, the entire 1/16 of an inch of the border area around the entire form of the Product carries no protection at all for the user. Due to the wide variety of potential applications of the Product, Angel Armor makes no claim as to how a Product will perform in a given situation. Use of the Product is at your own risk.
ii. Read all information supplied with Product carefully. It provides important information specific to the Product including the Standard and the types of threats against which the Product has been tested, as described above.
In compliance with the Standard, this Product is not intended for and should not be used as “body armor” or any other application directly on the body. Use of the Product directly on the body could result in serious injury or death.
iv. Even for those threats included within the Product’s specified NIJ threat level, the Product is only ballistic resistant, NOT “bullet proof.” Even where a Product has stopped a threat, some degree of injury to the user could occur, and death is still possible. Ballistics are highly unpredictable and projectiles of any sort can ricochet or deflect off of the Product, and/or shatter into fragments that can pass through the Product, in either case possibly resulting in injury or death.
v. The Product has been tested at and certified to meet the Standard only under those specific conditions listed on the Product label. Variations in projectile, caliber and velocity may affect Product performance. The greater the amount of impacts and the closer the proximity of each impact, the greater the possibility a projectile may penetrate the Product, resulting in serious injury or death.
vi. Purchaser or its agents must carefully inspect each Product unit before using it in conjunction with the appropriate bag, package or other container. Should the Product unit be broken, interrupted, cracked or damaged in any way, it should immediately be sent to Angel Armor or its authorized dealer for an inspection using the RMA process set out by Angel Armor. Do not use any Product unit if it is chipped, cracked, delaminated or separated or shows any other physical change or deterioration.
2. Scope and Duration of Our Express Limited Warranty; Sole and Exclusive Remedy.
a. Subject to all of the terms and conditions of this document, Angel Armor warrants to purchaser only that: (1) the Product has been tested against the Standard described in Section 1 above; (2) that for a period of sixty (60) months after the date of sale to the original purchaser, the Product shall be free from defects in material and workmanship; and (3) for a period of sixty (60) months after the date of sale to the original purchaser, the Product shall be free from unreasonable ultra-violet discoloration.
Testing done to determine if ultra-violet discoloration has occurred shall comply with ASTM Designation D1925-70.If Angel Armor in its sole and absolute discretion determines that a product does not conform to the express limited warranty in Section 2.a., Angel Armor shall at its election replace, repair, or issue a pro-rated purchase price credit for such Product unit. Such repair, replacement or refund shall be Angel Armor’s sole obligation and purchaser’s sole remedy with respect to a breach of warranty claim. A Return Materials Authorization (“RMA”) number must be obtained from Angel Armor prior to returning any Product.
IN NO EVENT SHALL ANGEL ARMOR (OR ANY OF OUR MEMBERS, MANAGERS, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS) BE LIABLE FOR ANY OF: (I) THE COST OF REPLACEMENT PRODUCTS; (II) ANY PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, ANTICIPATED OR LOST PROFITS, INCIDENTAL DAMAGES, LOSS OF TIME, OR OTHER INDIRECT LOSSES OR EXPENSES THAT ARISE FROM ANY CAUSE RELATING TO OUR PRODUCT, REGARDLESS OF THE FORM OF THE ACTION, WHETHER IN TORT (INCLUDING NEGLIGENCE), CONTRACT, STRICT LIABILITY OR OTHERWISE, AND REGARDLESS OF WHETHER ANGEL ARMOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; OR (III) DIRECT DAMAGES EXCEEDING THE PURCHASE PRICE ACTUALLY PAID FOR THE PRODUCT UNIT(S) GIVING RISE TO SUCH PURPORTED LIABILITY.
4. Conditions Precedent to and Limits on Warranty Coverage
a. Product Design and Dimensions. The Product is designed to allow for its insertion over certain areas of certain vehicle types specified in our individual Product specifications. Angel Armor also notifies purchaser that the design of the Product may allow it to be subject to risk of removal and theft, even if the vehicle is otherwise locked, and that installation of this Product may affect how vehicle performs in the event of an accident or a ballistic incident, including, but not limited to, any quick release functions. The Product is designed to be installed over a vehicle’s existing glass, and installation could lead to decreased or distorted visibility.
Our warranty also shall be void as to any Product unit that has been subjected to misuse, abuse, accident, neglect, breakage, alteration, damage, improper storage or handling, theft, or any repair or service not performed by Angel Armor. In addition to voiding out the warranty, any of the foregoing actions or events could cause the Product unit to fail and could expose the user to increased risk of serious injury or death.
Without limiting the generality of the foregoing, the Product is not designed to protect against bursting munition threats such as IED’s, mines, hand grenades, mortar fire and/or rifle fire, sharp-edged or pointed objects.
User should read and fully understand that Standard’s various threat levels, and the limitations on the protection afforded by each.
iv. Even for those threats included within the Product’s specified NIJ threat level, the Product is only ballistic resistant, NOT “bullet proof’. Even where a Product has stopped a threat, some degree of injury to the user could occur, and death is still possible. Ballistics are highly unpredictable and projectiles of any sort can ricochet or deflect off of the Product, and/or shatter into fragments that can pass through the Product, in either case possibly resulting in injury or death.
v. The greater the amount of impacts and the closer the proximity of each impact, the greater the possibility a projectile may penetrate the Product, resulting in serious injury or death.
Any of the foregoing may either cause the product to be ineffective or indicate that it has become ineffective, exposing the user to increased risk of serious injury or death.
Note to Purchaser: Angel Armor reserves the right in its sole and absolute discretion to modify or replace all or any portion of these policies with respect to subsequent transactions with purchaser.
